1. Agreement to these Terms
These Terms and Conditions (“Terms“) are a binding legal agreement between you and ZohaClick (“we,” “us,” or “our“) governing your access to and use of https://store.zohaclick.com and related pages, checkout, account areas, and services (collectively, the “Store“).
Important business model note: the Store sells digital products only. We do not sell or ship physical goods through this Store.
By browsing the Store, creating an account, placing an order, downloading products, or contacting support, you agree to these Terms. If you do not agree, do not use the Store.
2. Related policies
These Terms incorporate by reference our:
If there is a conflict, the more specific policy controls for that topic (for example, refunds are controlled by the Refund & Access Policy).
3. Eligibility and account responsibility
You may use the Store only if you can form a legally binding contract under applicable law. If you use the Store for a company, you represent that you have authority to bind that company.
You are responsible for account credentials, account activity, and keeping your email and billing details accurate. Notify us promptly if you suspect unauthorized access.
4. Digital products and license scope
Products sold on the Store are digital assets, such as templates, files, kits, guides, or downloadable resources. Your purchase grants a license to use the product as described on the product page and/or included license text; it does not transfer ownership of intellectual property unless expressly stated.
Unless a specific product license says otherwise, you may not:
- resell, sublicense, redistribute, or repackage purchased files as standalone products;
- share download links, account access, or files with unauthorized users;
- claim ownership of our original files, branding, or source assets.
Where a product includes third-party assets, use remains subject to those third-party license terms.
5. Orders and contract formation
When you place an order, you make an offer to buy digital content under these Terms. A contract is formed when payment is successfully processed and we accept the order. We may refuse, cancel, or limit orders where we identify pricing errors, fraud risk, compliance issues, abuse, or technical issues.
6. Pricing, tax, and currency
Prices are shown on the Store and may change before checkout completion. The total shown at checkout is the amount you authorize (except obvious pricing errors).
Applicable taxes (such as VAT, GST, or sales tax) may be calculated at checkout based on your billing location and legal requirements.
If multi-currency display is enabled, converted amounts are estimates and your payment provider may apply different exchange rates or fees.
7. Payments
Available payment methods are shown at checkout and may include cards, PayPal, WooCommerce Payments/Stripe-powered methods, ACH or bank-debit methods (where supported), and other processors. Payment processing is performed by third-party payment providers under their own terms and privacy rules.
We do not store full card numbers on our own servers. We may use fraud-prevention tools and may request verification before granting access to downloads.
8. Delivery of digital products
Digital products are typically delivered through:
- order confirmation email links, and/or
- your My account downloads area.
Access is usually immediate after successful payment, but may be delayed for fraud review, technical maintenance, or payment verification.
You are responsible for ensuring your device, software, and internet access can download and use purchased files, including any software requirements listed on product pages.
9. Download limits and access controls
We may apply reasonable anti-abuse controls (for example, time-limited links, download count limits, or account-bound access). If valid access is blocked in error, contact support and we will investigate.
10. Refunds and cancellations
Refund and cancellation rights are governed by our Refund & Access Policy and applicable consumer law.
Because products are digital and can be instantly accessed, change-of-mind refunds may be limited once download/access is provided, unless local law requires otherwise.
11. Acceptable use
You agree not to:
- use the Store in violation of law;
- attempt unauthorized access, scraping, reverse engineering of protected systems, or disruption of Store operations;
- use stolen payment methods or submit false identity/billing information;
- abuse discounts, referral systems, or promotional mechanisms.
We may suspend or terminate access for violations, fraud, abuse, or security risk.
12. Intellectual property
The Store, including text, branding, design, code, graphics, and product content, is owned by ZohaClick and/or licensors and is protected by intellectual property laws. No rights are granted except those expressly provided by these Terms or a product-specific license.
13. User submissions and feedback
If you submit feedback, suggestions, or ideas, you grant us a non-exclusive, worldwide, royalty-free license to use that feedback to improve our products and services, without obligation to compensate you.
14. Service availability
We aim for reliable availability but do not guarantee uninterrupted operation. The Store may be unavailable due to maintenance, upgrades, outages, security events, or third-party service disruptions.
15. Disclaimers
Except where prohibited by law, the Store and digital products are provided on an “as is” and “as available” basis. We disclaim implied warranties (including merchantability, fitness for a particular purpose, and non-infringement) to the maximum extent permitted by law.
Nothing in these Terms excludes or limits rights that cannot be excluded under mandatory consumer law.
16. Limitation of liability
To the fullest extent permitted by law, ZohaClick is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption arising from use of the Store or products.
To the fullest extent permitted by law, our total liability for claims relating to an order is limited to the amount paid for that order.
17. Indemnity
You agree to indemnify and hold harmless ZohaClick, its affiliates, and service providers from claims, liabilities, and expenses arising from your misuse of the Store, violation of these Terms, or infringement of rights of another party.
18. Chargebacks and disputes
If you have an issue with access or files, contact us first through Contact. Opening a chargeback or payment dispute while support is actively resolving an issue may delay resolution. We may provide relevant order and access records to payment processors as part of dispute handling.
19. Privacy and data handling
Your personal information is processed according to our Privacy Policy. By using the Store, you acknowledge those practices.
20. Governing law and disputes
These Terms are governed by the laws applicable to the Store operator, except where mandatory consumer-protection law in your jurisdiction applies. Venue and dispute process may be described in additional legal notices or required by applicable law.
21. Changes to these Terms
We may update these Terms from time to time to reflect legal, operational, or product changes. Updated Terms become effective when posted with a revised “Last updated” date unless a different date is stated.
For material changes, we may provide additional notice through the Store or email where required by law.
22. Contact
For questions about these Terms, orders, licenses, or digital access, contact us through Contact or email [email protected].
